This document constitutes a public offer and sets forth the terms under which online services are provided.

1. General Provisions
1.1. These Terms govern the relationship between
Valerii Alexandrovich Pozniakov (hereinafter referred to as the “Provider”)
and any individual who accepts these Terms by making a payment (hereinafter referred to as the “Client”).
1.2. Acceptance of these Terms occurs upon payment for any service offered on the Website.
1.3. Upon payment, a binding agreement is considered concluded between the Provider and the Client.

2. Services
2.1. The Provider offers online coaching and consulting services, including:

• Online Consultation
• Online Coach (monthly support program)
• Online FYSM Practice
• Coaching Session

2.2. All services are delivered remotely via Zoom, Telegram, or another mutually agreed online platform.
2.3. Services are informational, educational, and advisory in nature.

3. Pricing and Payment
3.1. The minimum price for each service is indicated on the Website.
3.2. The Client may choose to pay an amount higher than the stated minimum at their discretion.
3.3. Payments are processed through third-party payment providers, including PayPal and Stripe.
3.4. The Provider does not store or have access to credit card information.
3.5. For the monthly support program, the start date of services shall be agreed upon after payment.
The duration of the monthly support is 30 calendar days from the date of the first agreed session or the commencement of actual support, provided the Client engages in timely communication.

4. Service Delivery
4.1. The date and time of sessions are agreed individually between the parties.
4.2. The Client must notify the Provider at least 24 hours in advance if rescheduling or cancelling a session.
4.3. If no notice is provided within 24 hours prior to the scheduled session, the session shall be considered delivered.
4.4. In case of technical issues, the parties may reschedule the session or agree on an alternative platform.

5. Refund Policy
5.1. The Client may request a refund prior to the commencement of services.
5.2. Once a service has been delivered, no refund shall be issued.
5.3. For the monthly support program, a partial refund may be granted at the Provider’s discretion for the unused portion of the service period.
5.4. If the Client fails to initiate communication and does not coordinate the start date of services within 14 calendar days after payment, the service shall be considered available for delivery, and no refund will be provided.

6. Limitation of Liability
6.1. The services provided are not medical services and do not replace professional medical advice.
6.2. The Client confirms that they have no medical contraindications to physical activity, training, dietary changes, or related practices.
6.3. The Client is solely responsible for their health condition and for implementing any recommendations provided.
6.4. The Provider does not guarantee specific results, as outcomes depend on the Client’s personal effort, consistency, and individual circumstances.
6.5. Services are available only to individuals aged 18 years or older.

7. Privacy
7.1. Personal data is processed in accordance with the Privacy Policy available on the Website.

8. Force Majeure
8.1. Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control.

9. Final Provisions
9.1. The Provider reserves the right to modify these Terms at any time without prior notice.
9.2. The current version of the Terms shall always be available on the Website.
